Agreement for Rose Photography Services – Please Read Carefully

  1. Whilst Rose Photography will always do their very best to deliver the photographs the Client is looking for, unfortunately there are a number of challenges that can impact the final images (e.g. with babies it depends on how settled the Client’s child is on the day, for toddlers it’s very much dependent on their mood and the weather can provide its own set of challenges). Rose Photography are extremely confident that they will deliver images that the Client is delighted with, but the Client does need to be aware of these challenges and the impact they can have on the final outcome.
  2. The Experience Fee covers Rose Photography’s time and the products included in the Client’s chosen Experience. 50% of the Experience fee is payable at the time of booking confirmation (instalment 1). The remaining 50% (instalment 2) is due on the day the Client receives their final products (e.g. access to their final edited digital images or when they pick up any physical products from the Rose Photography Studio). Instalments can be paid to Rose Photography via Direct Credit to the following Bank Account: BANK: CBA; BSB: 062-458; ACCOUNT NUMBER: 1018 1929; REFERENCE: Client to include their last name and shoot date if a reference field is available. Upon receipt of Instalment 1 Rose Photography will send an email receipt to the Client confirming that their booking has been secured. Instalment 2 must also be paid via Direct Credit. Rose Photography will email a receipt to the Client within 24 hours of payment being received.
  3. The Client shall reimburse Rose Photography for any additional costs incurred for travel, parking and other reasonable costs necessary to the performance of these services. Such charges will be agreed in writing before the expense is incurred.
  4. If it is not possible for a session to take place on a scheduled day for emergency or medical reasons, Rose Photography and the Client will reschedule on an agreed date at the earliest date possible, at no extra charge. Rescheduling for any other reason requires as much notice as possible, with a minimum of 48 hours required. If 48 hours notice is not provided Rose Photography reserves the right to charge $170 for any reschedule.
  5. For all Experiences, except Weddings, if the Client wishes to cancel their shoot they may do so with no charge at any point up to within 7 calendar days of the agreed shoot date. If the Client cancels within 7 calendar days of the agreed shoot date, Rose Photography reserves the right to charge the Client $170 as this date and time has been held for the Client and Rose Photography are unlikely to be able to rebook this slot at such short notice. For all Weddings Experiences, if the Client wishes to cancel their shoot they may do so with no charge at any point up to within 14 calendar days of the agreed shoot date. If the Client cancels within 14 calendar days of the agreed shoot date, Rose Photography reserves the right to charge the Client $500 for Weddings Basic Experience and Weddings Traditional Experience and $650 for Weddings Luxury Experience.
  6. Rose Photography will take approximately 2 weeks after the shoot to sort, edit and load images to a password protected online gallery, available to be viewed at rosephotography.com.au. Once the Client has selected the final images (which may be done online or in person, depending on the Experience the Client ordered) Rose Photography will provide all of the final elements of the agreed Experience package within 4 weeks.
  7. High resolution JPEG images will be sent to the Client via Rose Photography’s secure online file sharing service (box.com) or via post on a USB drive if internet access is not available. Images are provided as high resolution JPEG files. Images will be provided fully edited, including stray hair removal, skin correction, removal of scars and heavy blemishes as agreed with the Client. All final images will be included in two finishes as agreed with the Client (e.g. colour, black & white, sepia, bleached).
  8. Rose Photography shall not be responsible for photographs not taken as a result of the Clients failure to provide reasonable assistance or cooperation. Rose Photography is not responsible if the Client and/or key individuals fail to appear or cooperate during shoots, or for missed images due to details not revealed to Rose Photography.
  9. Rose Photography retains copyright of the photographs, and hereby grants the Client unlimited, but non-exclusive rights, to use or reproduce the photographs.
  10. The Client grants Rose Photography unrestricted right to use and publish photographs for editorial, trade, advertising and other purposes.
  11. The Client will not hold Rose Photography responsible for any accidental injury incurred before, during or post the session.
